TreadMark Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TreadMark mobile application ("TreadMark," "the App," or "we/us/our"). By downloading, installing, or using TreadMark, you agree to these Terms. If you do not agree, do not use the App.

1. About TreadMark

TreadMark is a local utility for tracking wear and maintenance of everyday commuting items such as shoes, bag straps, umbrella handles, card holders, and similar personal gear. The App lets you:

  • Add and organize items you choose to track
  • Capture or import photos of item wear
  • Mark worn areas on photos
  • Record wear level, use frequency, text notes, and optional voice notes
  • View wear scores, timelines, and item history
  • Add maintenance ("fix") notes
  • Archive or restore items
  • Create local reminders
  • Purchase consumable in-app products that add Points to your local balance
  • Export a local wear status summary using Points (where available)

TreadMark is designed to work primarily on your device. It is not a social network, marketplace, authentication service, cloud backup service, or professional inspection tool.

2. Eligibility

You must be at least 13 years old, or the minimum age required in your jurisdiction to consent to use of the App, to use TreadMark. If you are under the age of majority where you live, you may use the App only with permission from a parent or legal guardian who accepts these Terms on your behalf.

3. Local Account

TreadMark uses a device-local profile for access control within the App. When you use Quick Sign In, the App may generate a local username and password and store them on your device. This profile:

  • Is not a remote account
  • Is not verified against any server operated by us
  • Cannot be recovered on another device unless you manually retain your credentials
  • Is not intended for identity verification or security outside the App

You are responsible for safeguarding any credentials stored on your device. Logging out keeps your local profile on the device. Deleting your account removes the saved local credentials from the device but does not by itself delete all App content such as item records, photos, or Points data unless you remove the App or clear its data through your device settings.

4. Acceptable Use

You agree to use TreadMark only for lawful personal purposes. You may not:

  • Use the App in a way that violates applicable law or third-party rights
  • Attempt to reverse engineer, decompile, or disrupt the App except where permitted by law
  • Misrepresent wear records as professional inspections, certifications, warranties, or safety approvals
  • Use the App to harass, abuse, or harm others
  • Upload or record content you do not have the right to use

We may suspend or restrict access to the App if we reasonably believe you have violated these Terms, to the extent permitted by applicable law and platform rules.

5. Your Content

You retain ownership of photos, notes, voice recordings, and other content you create in TreadMark ("User Content"). By using the App, you grant us only the limited rights needed to store and display User Content locally on your device so the App can function.

You are solely responsible for User Content and for ensuring that your use of camera, photo library, microphone, and notification features complies with applicable law and the rights of others.

6. Wear Scores and Informational Limits

Wear scores, status labels, reminders, and summaries in TreadMark are informational tools based on your inputs and local rules inside the App. They are not:

  • Professional repair advice
  • Product safety determinations
  • Authenticity or valuation judgments
  • Medical, legal, or financial guidance

Do not rely on TreadMark as a substitute for qualified inspection, manufacturer guidance, or professional maintenance decisions.

7. Points and In-App Purchases

TreadMark offers consumable in-app purchases that add Points to a local balance. Points may be used for App features such as exporting a wear summary or unlocking additional local usage capacity, as shown in the App at the time of use.

Important terms about Points:

  • Points have no cash value outside the App
  • Points are non-transferable and tied to your local App data
  • Points are not refundable except where required by applicable law or platform policy
  • Purchases are processed by Apple through the App Store; billing, payment, and refund requests are handled under Apple's terms
  • Product names, prices, and Point amounts may change; the App Store purchase sheet shows the current offer
  • If you delete the App or lose local data, your Points balance and records may be lost unless you have a device backup

Free usage limits may apply to certain features. The App is designed so core wear-tracking flows remain usable within those limits.

8. Permissions and Device Features

TreadMark requests device permissions only when you choose a related action:

  • Camera: to take wear photos
  • Photo Library: to import wear photos
  • Microphone: to record optional voice notes
  • Notifications: to deliver local reminders you create

You may continue using alternative paths when a permission is denied, such as text-only notes or placeholders where supported.

TreadMark does not require location, contacts, or background tracking permissions for its core features.

9. Privacy

Your use of TreadMark is also governed by our Privacy Policy, which explains how information is handled on your device. The Privacy Policy is incorporated into these Terms by reference.

10. Intellectual Property

The App, including its design, code, branding, and documentation (excluding User Content), is owned by us or our licensors and is protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding except as needed to use the App as intended.

11. Third-Party Services

The App relies on Apple platform services, including the App Store and StoreKit. Your use of those services is subject to Apple's applicable terms and policies. We are not responsible for third-party services outside our control.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TREADMARK IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, secure, or that data will never be lost. You are responsible for maintaining backups of important information stored on your device.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO YOUR USE OF THE APP.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US THROUGH IN-APP PURCHASES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnity

You agree to defend, indemnify, and hold us harmless from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the App, your User Content, or your violation of these Terms, except to the extent caused by our intentional misconduct or as prohibited by law.

15. Changes to the App and Terms

We may update the App or these Terms from time to time. If we make material changes, we will provide notice within the App or through other reasonable means. Continued use after the effective date of updated Terms constitutes acceptance, except where applicable law requires otherwise.

16. Termination

You may stop using TreadMark at any time by deleting the App from your device. We may discontinue or modify the App, in whole or in part, at any time. Sections that by their nature should survive termination will survive, including disclaimers, limitations of liability, and governing law.

17. Governing Law

These Terms are governed by the laws applicable in the jurisdiction where the developer of TreadMark is established, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country of residence require otherwise.
